These terms apply to marzan.com.au and to everything we make and sell. By using this site, enquiring, ordering, or registering a piece, you agree to them.

Enquiries and orders

Prices and pieces shown on this site are an invitation to enquire, not an offer to sell. An enquiry is not an order. A piece is only ordered once we have confirmed the details and the price with you in writing and, where one applies, received your deposit.

We may decline an enquiry or order. If we do, we will tell you why and refund anything you have paid.

Bespoke and made-to-order pieces

Most of what we make is made for one person.

• We will agree the design, materials, sizing and price with you before work begins.
• A deposit is usually required, and it is non-refundable once making has started, because the work cannot be undone or resold.
• Handmade pieces vary slightly. Stones vary in colour and character. These are not faults.
• Timeframes we quote are estimates made in good faith.

Because a bespoke piece is made to your specification, you do not have a right to change your mind and return it. This does not affect your rights under the Australian Consumer Law — see below.

Your rights under Australian Consumer Law

Nothing in these terms excludes, restricts or modifies the consumer guarantees under the Australian Consumer Law, and nothing here is intended to.

Our goods come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they are not of acceptable quality and the failure does not amount to a major failure.

If something we made is faulty, not as described, or not of acceptable quality, contact us at info@marzan.com.au and we will put it right.

The Graduation Collection

Registering a piece is not a purchase. Registration records that a piece belongs to you, so that we know it is yours and can help you look after it.

If your piece ever needs attention — cleaning, resizing, or a repair — bring it to us and we will look after it. We will quote you before any work is done.

We do not currently offer a separate warranty or replacement programme. Your rights under the Australian Consumer Law apply to every piece we make, and are set out above.

School crests and other marks

School crests, badges and names belong to the schools. We engrave them with the school's permission, for pieces made under a programme agreed with that school. Nothing on this site grants you any right to use a school's crest.

Our own designs, photographs, text and the MARZAN name and marks belong to us. You may not copy or reproduce them without our written permission.

Prices and payment

Prices are in Australian dollars and include GST unless we say otherwise. Quoted prices for bespoke work are valid for 30 days, because metal and stone prices move.

Delivery

We will agree delivery or collection with you. Risk passes to you when the piece is delivered to you, to the school, or to the address you gave us.

For School Collection pieces, delivery is to the school unless agreed otherwise.

This website

We try to keep the site accurate and available, but we do not guarantee either. Images are representative; handmade pieces vary. We may change or withdraw any part of the site at any time.

Liability

To the extent the law allows, and other than the consumer guarantees described above, we are not liable for indirect or consequential loss. Nothing here limits liability that cannot lawfully be limited — including for death or personal injury caused by our negligence, or for fraud.

Privacy

How we handle personal information is set out in our Privacy Policy, which forms part of these terms.

Governing law

These terms are governed by the law of New South Wales, Australia, and the courts of New South Wales have jurisdiction.

Changes

We may update these terms. The version on this page at the time you order or register is the one that applies to you.
